Terms of Service

1. Agreement to Terms

By accessing or using Preval ("the Service"), operated by THINNESTAI PRIVATE LIMITED ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Preval is an AI agent observability, evaluation, and testing platform. The Service provides trace ingestion, automated evaluations, prompt experimentation, PII detection, and related tooling for AI applications. We offer both cloud-hosted and self-hosted deployment options.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials, including API keys. You must notify us immediately of any unauthorized use of your account.

4. Bring Your Own Keys (BYOK)

Preval supports a Bring Your Own Keys model. When you provide third-party API keys (e.g., OpenAI, Anthropic, Google), those keys are encrypted at rest and used solely to execute requests on your behalf. We do not use your API keys for any other purpose. You are responsible for any charges incurred with third-party providers through your keys.

5. Data & Privacy

We collect and process trace data, evaluation results, and usage metrics as necessary to provide the Service. Your trace data remains your property. We do not sell, share, or use your data for training AI models. For detailed information, see our Privacy Policy.

6. Acceptable Use

You agree not to:

• + Use the Service for any unlawful purpose
• + Attempt to gain unauthorized access to any part of the Service
• + Reverse engineer, decompile, or disassemble the Service
• + Interfere with or disrupt the integrity or performance of the Service
• + Resell or redistribute the Service without written consent

7. Billing & Payment

Paid plans are billed monthly or annually in advance. Prices are in USD and exclude applicable taxes. We may change pricing with 30 days' notice. Overage charges are billed at the rates specified in your plan. The Free plan has hard usage limits and does not incur overage charges.

8. Intellectual Property

The Service, including its design, code, and documentation, is owned by THINNESTAI PRIVATE LIMITED. You retain ownership of your data and content. The Preval SDK is licensed under the MIT License. Open-source attributions are listed in our Third-Party Licenses page.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINNESTAI PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. We will retain your data for 30 days after termination, after which it will be permanently deleted unless required by law.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
